Terms of Service

These Terms govern use of OpenBrain (“the App”), a personal productivity tool developed by David Chang (“I”, “me”, “my”). The App’s source code is published at https://github.com/davidianstyle/openbrain and these Terms are hosted at https://davidchang.dev/terms-of-service/.

Acceptance

By installing, configuring, or using OpenBrain, you agree to these Terms. If you do not agree, do not install or use the App.

What OpenBrain is

OpenBrain is an open-source, self-hosted “AI Chief of Staff” that you install and run on your own computer. It connects to your own Google account (and optionally Slack, Asana, and Fathom accounts) via locally-installed MCP servers, and uses Claude Code (from Anthropic) as the local agent that reads and acts on your data.

There is no hosted OpenBrain service. You operate your own copy.

License

OpenBrain is distributed under the license stated in the repository’s LICENSE file. These Terms are in addition to, and do not replace, that license.

Use of the App

You agree to use OpenBrain only:

  • For your own personal use, on accounts you own or are authorized to access.
  • In compliance with applicable law and with the terms of any third-party service it connects to (including Google, Anthropic, Slack, Asana, and Fathom).
  • Without attempting to use it to access accounts or data that do not belong to you.

You are solely responsible for the credentials, tokens, and content stored on your own machine, and for the actions the App takes on your behalf when you ask Claude Code to operate on your data.

Third-party services

OpenBrain integrates with third-party services that have their own terms and privacy policies, including:

  • Google — https://policies.google.com/terms
  • Anthropic / Claude Code — https://www.anthropic.com/legal/commercial-terms
  • Slack, Asana, Fathom — see each provider’s terms.

Your use of those services through OpenBrain is governed by their respective terms, in addition to these.

Google account integration

When you connect a Google account, you authorize OpenBrain to access only the scopes you approve on Google’s consent screen. You may revoke that access at any time at https://myaccount.google.com/permissions. OpenBrain’s handling of Google user data is described in the Privacy Policy.

No warranty

OpenBrain is provided “as is” and “as available”, without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the App will be error-free, uninterrupted, or that it will produce accurate or correct results. The App’s outputs are generated by a large language model (Claude) and may contain mistakes; you are responsible for reviewing any action it suggests or any draft it produces before you rely on it or send it.

Limitation of liability

To the maximum extent permitted by law, in no event will I be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, revenue, goodwill, or business, arising out of or related to your installation or use of OpenBrain, even if advised of the possibility of such damages. My total aggregate liability for any claim arising out of or related to the App will not exceed USD $50.

Because OpenBrain runs on your own machine and acts on your own credentials, you are responsible for any side effects of its operation on your own accounts (for example, drafts saved, calendar events created, files written) and for reviewing them before relying on them.

Indemnification

You agree to defend, indemnify, and hold me harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of OpenBrain in violation of these Terms or applicable law.

Changes

I may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Your continued use of OpenBrain after a change constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.
